Auxillo is operated by Jaundre van Staden, trading as Auxillo, an individual trader (Empresário em Nome Individual), NIF 309215099, CAE 58290, 62202 and 63110. Address: Rua da Comporta 12, 2D, 8500-454 Portimão, Portugal.
1. Your agreement with Auxillo
These terms apply when you create an Auxillo account or order a service. The order summary identifies the service, price, billing period and any agreed specification. Read it before confirming a purchase. Browsing the website alone does not create a paid subscription. Mandatory consumer rights apply regardless of these terms.
The Acceptable Use Policy, the Data Processing Agreement, the Refund Policy and, for covered paid services, the Service Level Agreement form part of these terms. By creating an account or placing an order you accept them, including the Data Processing Agreement, which governs personal data that Auxillo processes on your behalf as processor under Article 28 GDPR. Our Privacy Policy explains the personal data processing for which Auxillo is the controller. A specific written order takes precedence for its service specification; it cannot remove mandatory rights.
2. Services and availability
Auxillo offers diagnostic tools, email software, desktop applications and hosting services. The current product page and accepted order determine what is included. A catalogue listing, preview or request-for-setup form does not mean that a service is ready for immediate purchase or automatic provisioning. Services marked as available by arrangement require confirmation before delivery and billing.
Plan limits, supported features, storage and support arrangements are stated on the applicable order. Additional capacity or work requires agreement. Customer-selected software, third-party licences, external mail providers and AI model services may have separate terms and charges.
3. Accounts and authorised use
Provide accurate account and billing details, keep credentials private and tell us promptly about suspected unauthorised access. You must have authority to act for an organisation and to connect any mailbox, domain, machine or other resource. Use the services lawfully and within the agreed limits. You retain responsibility for your content, users and instructions to software running on your machines.
Accounts are intended for adults with capacity to contract. Do not create an account for a child. Contact us before using a service for regulated or particularly sensitive workloads so that suitability and responsibilities can be agreed.
4. Prices, payment and renewal
Prices are in euros unless an order states otherwise. The checkout or written order shows the billing period, applicable tax and total payable before confirmation. Recurring services renew for the displayed period until cancelled. Payment is processed through Stripe; we do not store full payment card numbers.
Cancel renewal through the account billing controls or contact [email protected] if those controls are unavailable. Cancellation of renewal normally leaves service available until the end of the paid period. Withdrawal, remedies for a defective service and agreed refunds are separate rights described in the Refund Policy. We will give notice of changes to recurring charges before they apply; you may cancel renewal before the changed price takes effect.
5. Delivery, changes and support
We provide the service described in the accepted order and the updates required by applicable law. Delivery times depend on the product and any setup agreed with you. We will tell you if we cannot fulfil an order and arrange the appropriate cancellation or refund.
Contact [email protected] for support. Standard support hours are Monday to Friday, 09:00 to 18:00, Europe/Lisbon time, excluding Portuguese public holidays. Product-specific support arrangements and service credits are described in the SLA or your order. Estimated response and resolution times are not a guarantee that every issue can be resolved within that time.
6. Your data and backups
You retain ownership of your content and give us permission to process it only as needed to deliver the service, follow lawful instructions and meet legal obligations. If we process personal data on your behalf, the Data Processing Agreement, which forms part of these terms (section 1), applies.
Keep an independent copy of important data. Backup frequency, restore options and customer encryption responsibilities depend on the service actually ordered; a backup feature on another product is not included automatically. Export required data before closing a service and contact support to agree any retrieval assistance. The retention schedule explains recovery copies and legal records.
7. AMI and automated features
AMI is an AI assistant operated by Auxillo. Its responses can be incomplete or incorrect. Review advice and commands before relying on them, especially where a mistake could affect data, security or spending. Do not submit credentials or unnecessary personal data. The AMI Usage Policy explains conversation processing and permitted use.
Routine billing, monitoring and provisioning may be automated. If you believe an account restriction or other decision is wrong, contact support for review. An AI response does not amend an order or these terms.
8. Software and intellectual property
Auxillo branding and proprietary software remain the property of their respective rights holders. Your subscription provides the access needed to use the purchased service; it does not transfer ownership.
Open-source releases have their own licences. Aux Command is licensed under AGPL-3.0-or-later and Aux Proton Drive Bridge under the MIT licence, as included with those releases. Those licences govern use, modification and redistribution of that code. Third-party components retain their own licences.
Software you choose. You are responsible for holding and complying with the licences and terms of any game, application or other software you choose to run on an Auxillo service, including any end-user licence agreement and any account, token or key it requires. When you accept such terms while ordering, you authorise Auxillo to install and configure that software for you on the basis of your acceptance. Auxillo does not become a party to those terms.
9. Suspension and ending a service
We may restrict access where reasonably necessary to address non-payment, a material breach, a security risk or a binding legal requirement. Where practicable, we will explain the issue and give you an opportunity to resolve it. Immediate action may be necessary to protect people, data or infrastructure. You can ask for review at [email protected].
Termination does not automatically remove accrued payment obligations, lawful retention duties or your right to an applicable refund or remedy. We will give appropriate notice of material service changes or discontinuation, subject to urgent security or legal needs and mandatory law.
10. Responsibility and mandatory rights
We are responsible for providing the agreed service with the care and conformity required by applicable law. We cannot promise uninterrupted operation or perfect results from every external system. You are responsible for lawful content and actions you authorise, but this does not exclude our responsibility for our own breach.
Nothing in these terms excludes or limits liability where prohibited by law, including mandatory consumer remedies, fraud, deliberate misconduct or other non-excludable liability. Open-source warranty provisions apply to their respective releases to the extent permitted by law.
11. Complaints, governing law and changes
Contact [email protected] with a complaint, your order reference and the outcome you seek. Portuguese law governs the agreement. Consumers retain mandatory protections and rights to bring proceedings in the courts available under applicable consumer law, including in their country of residence where applicable.
Portuguese consumers may contact the competent consumer arbitration body. Direção-Geral do Consumidor publishes information about recognised alternative dispute resolution bodies. The former EU Online Dispute Resolution platform has closed. Privacy complaints can be made to the CNPD; it is not a billing dispute service.
We publish dated revisions here and notify affected customers of material contractual changes where required. Changes do not retrospectively remove accrued rights.
